It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results and consequences (...) of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. This paper consists in a reflection on the conceptual nerve center of Franz Rosenzweig’s thought and heritage that is the category of redemption as an epistemological category. The reflection is articulated through a comparative study of the redemptive epistemologies of three modern Jewish thinkers: Franz Rosenzweig, Rabbi Yoseph Dov Soloveitchik and HaRav Avraham Yitzchak HaCohen Kook. The comparison arises from a basic feature that this paper identifies as common to all three modern visions of epistemic Jewish redemption: they all (...) feature Hegelian interpretations of the traditional Jewish category of teshuva. Transhumanists would have humanity's creation of posthumanity be our governing aim. Susan B. Levin challenges their overarching commitments regarding the mind, brain, ethics, liberal democracy, knowledge, and reality. Her critique unmasks their notion of humanity's self-transcendence via science and technology as pure, albeit seductive, fantasy.

Susan B. Levin argues that Plato's engagement with medicine is richer than previously recognized and that he views it as an important rival for authority on nature and flourishing. Levin shows further that Plato's work, particularly the Laws, holds significant promise for bioethics that has so far been nearly untapped.

This is a unique study, contuining the work of Merleau-Ponty and Heidegger, and using the techniques of phenomenology against the prevailing nihilism of our culture. It expands our understanding of the human potential for spiritual self-realization by interpreting it as the developing of a bodily-felt awareness informing our gestures and movements. The author argues that a psychological focus on our experience of well-being and pathology as embodied beings contributes significantly to a historically relevant critique of ideology. It also provides an (...) essential touchstone in experience for a fruitful individual and collective response to the danger of nihilism. Dr Levin draws on Merleau-Ponty's phenomenology to clarify Heidegger's analytic of human beings through an interpretation that focuses on our experience of being embodied. He reconstructs in modern terms the wisdom implicit in western and semitic forms of religion and philosophy, considering the work of Freud, Jung, Focault and Neitzsche, as well as that of American educational philosophers, including Dewey. In particular, he draws on the psychology of Freud and Jung to clarify our historical experience of gesture and movement and to bring to light its potential in the fulfilment of Selfhood. In a study that goes beyond the ego affirmed by Freudian psychology, David Levin offers an account of personal growth and self-fulfillment based on the development of our capacity for listening. Drawing on the work of Dewey, Piaget, Erikson, and Kohlberg, he uses the vocabulary of phenomenological psychology to distinguish four stages in this developmental process and brings us the significance of these stages for music, psychotherapy, ethics, politics, and ecology. This analysis substantiates his claim that the development of our (...) listening capacity is a process that fits Foucault's conception of a practice of the self, forming our character as social beings and moral agents. In this study, Levin explores Plato's engagement with the Greek literary tradition in his treatment of key linguistic issues. This investigation, conjoined with a new interpretation of the Republic's familiar critique of poets, supports the view that Plato's work represents a valuable precedent for contemporary reflections on ways in which philosophy might benefit from appeals to literature.

Recently, a number of experiments have emphasized the degree to which subjects fail to detect large changes in visual scenes. This finding, referred to as “change blindness,” is often considered surprising because many people have the intuition that such changes should be easy to detect. Levin, Momen, Drivdahl, and Simons documented this intuition by showing that the majority of subjects believe they would notice changes that are actually very rarely detected. Thus subjects exhibit a metacognitive error we refer to as (...) “change blindness blindness.” Here, we test whether CBB is caused by a misestimation of the perceptual experience associated with visual changes and show that it persists even when the pre- and postchange views are separated by long delays. In addition, subjects overestimate their change detection ability both when the relevant changes are illustrated by still pictures, and when they are illustrated using videos showing the changes occurring in real time. We conclude that CBB is a robust phenomenon that cannot be accounted for by failure to understand the specific perceptual experience associated with a change. (shrink)

Levin examines texts by Descartes, Husserl, Wittgenstein, Nietzsche, Heidegger, Benjamin, Merleau-Ponty, and Lévinas, using our culturally dominant mode of perception and the philosophical discourse it has generated as the site for his critical reflections on the moral culture in which we are living. In Levin's view, all these philosophers attempted to understand, one way or another, the distinctive pathologies of (...) the modern age. But every one also attempted to envision—if only through the faintest of traces, traces of mutual recognition, traces of another way of looking and seeing—the prospects for a radically different lifeworld. The world, after all, inevitably reflects back to us the character, the reach and range, of our vision. In these provocative essays, the author draws on the language of hermeneutical phenomenology and at the same time refines phenomenology itself as a method of working with our experience and thinking critically about the culture in which we live. This article juxtaposes Anna Pawełczyńska’s writings with the works of Meir Dworzecki and Dov Levin. It will adopt a threefold analytical lens: first, using Pawełczyńska’s writings to reassess the conception of the early resistance that Dworzecki elaborated, second utilising Dworzecki’s viewpoint as a means to articulate Pawełczyńska’s perspective of Amidah, and then looking at Levin’s perspective on Pawełczyńska’s use of partisan testimony as a historical source. The main aims are to contribute to today’s debates on the Jewish resistance and the (...) relevance of partisanship in Holocaust historiography. The article also highlights some debates on the relationship between history and memory, as well as the necessity of rethinking Catholic-Jewish relations in Poland before and after the war. It presses for a new discussion of Dan Michman’s discourse of Jewish resistance, or Yehuda Bauer’s conceptualisation of it, and underscores the originality of Levin’s thought on memory as an essential tool for history. By way of a conclusion, the reader is invited to rethink the Polish World War II historiography and to read Rabbi Joseph Soloveitchik’s contribution about the blessings of the Amidah. (shrink)

Flora Levin explores how and why music was so important to the ancient Greeks. She examines the distinctions that they drew between the theory of music as an art ruled by number and the theory wherein number is held to be ruled by the art of music. These perspectives generated more expansive theories, particularly the idea that the cosmos is a mirror-image of music's structural elements and, conversely, that music by virtue of its cosmic elements - time, motion, and the (...) continuum - is itself a mirror-image of the cosmos. These opposing perspectives gave rise to two opposing schools of thought, the Pythagorean and the Aristoxenian. Levin argues that the clash between these two schools could never be reconciled. Her book shows how the Greeks' appreciation of the profundity of music's interconnections with philosophy, mathematics, and logic led to groundbreaking intellectual achievements that no civilisation has ever matched. Eugene Gendlin's contribution to the theory of language is the focus of this collection of essays edited by David Michael Levin.

Limitations of space dictate that we confine ourselves to Miss Stern's most salient comments. First, a preliminary point. Miss Stern says “Levin offers no argument” for why “e happened because of c” implicitly contains an explanatory description, while “c caused e” does not. But surely the remark that we often know that c caused e without knowing why c caused e is just such an argument. Our linguistic intuition suggests that we use the first locution in this case; Miss Stern's (...) evidently does not. Cases of non-diagnostic causal ascriptions do exist, and even ordinary language must provide for them; how it does so is a verbal dispute about English. (shrink)

Perhaps there is nothing morally wrong with homosexuality. But does that mean that those who find it abhorrent should be forced to tolerate, it? Michael Levin questions some common liberal preconceptions about homosexuality, and also responds to my own (which appeared in Issue 5 of Think).

Performing Ground is the first book to explore camouflage as a performance practice, arguing that the act of blending into one's environment is central to the ways we negotiate our identities in and through space. Laura Levin tracks contemporary performances of camouflage through a variety of forms - performative photography; environmental, immersive, and site-specific performance; activist infiltration; and solo artworks - and rejects the conventional dismissal of blending in as an abdication of self. ' But neither a text nor a confession can exist without a reader, or an other. Like it or not, we readers are participants in the rite of Rousseau's confessions. Do we have anything to confess? When the reading of a confession uncovers the spelling of a curse, so that the self-accused (...) author appears to accuse his readers, the discoverers of the curse can no longer pretend their neutrality and innocence. In fact, the detectives must assume the identity of the accused. In such a special case, then, the inevitable work of textual interpretation magically doubles as the story of a mysteriously elusive "crime" and its final, or anyway presumed detection. But, as in the very best of such stories, neither the skillfully executed crime nor its invisible author—if indeed these terms denote anything at all—need be what they seem. So perhaps the only thing we can say for sure here is that the spelling of the curse is the curse of spelling. And this puts us on the track of a mystery as ancient as the art of writing itself—a mystery whose story the scholars of hermeneutics have thus far preferred to ignore. The mystery I have in mind is the secret affinity between writing and death. A careful hermeneutic approach to Plato's critique of writing, however, may give us a crucial clue. For what binds written language to the power of death is its role in mourning, its incarnation in the form of shadows: black configurations of shadows placed for visibility against the white of the paper. In Plato's Myth of the Cave, the crime of writing is dimly adumbrated. Writing is idolatry, worship of false images, shadows. Rousseau's Confessions, written near the end of his life in the shadow of death, does not escape the shadows of doubt and suspicion which we, his readers, having discovered our own selves inscribed into the darkness of the text, cannot easily refrain from casting. But as soon as we recognize in the shapes of these shadows a suspicion for which 76 David Michael Levin77 we are responsible, we must confess our fatal complicity in the closing of the hermeneutical circle. Commentary on the Text If Rousseau's Confessions does not read like the typical memoir, neither does it read like the typical confession. A final twist awaits us. We read with a certain innocence, or faith, not prepared for the transitive conclusion: the text, as it happens, will bequeath a monstrous and impossible burden. What is the reader to do? How could it be that this man, who seemed to honor us, and won our trust with the candor of his revelations, should so boldly, by one cross conceit, vanish, only to leave us double-crossed and within a labyrinth which, as he would have us believe, we ourselves have wrought? What are we to make of his work? At first, the Confessions appears to be a work of light: with dazzling clarity of mind and courage no less prismatic, Rousseau proposes to take his readers into the gloomy chasms of his soul. "My purpose," he declares, "is to display to my kind a portrait in every way true to nature, and the man I shall portray is myself" (p. 17). That this, however, is not the whole of his intention, we learn through a neighboring sentence. For he says: "Let the last trumpet sound when it will, I shall come forward with this work in my hand, to present myself before my Sovereign Judge, and proclaim aloud: 'Here is what I have done'..." (p. 17). And yet, even this does not fully disclose his design, since he concedes, somewhat later, that "it is as if, feeling my life escaping from me, I were trying to recapture it at its beginnings" (p. 31). But in the end, as in the beginning, darkness and light are one. When do two sentences say the same thing, that is, express the same content? We defend two-component (2C) semantics: the view that propositional contents comprise (at least) two irreducibly distinct constituents: (1) truth-conditions and (2) subject-matter. We contrast 2C with one-component (1C) semantics, focusing on the view that subject-matter is reducible to truth-conditions. We identify exponents of this view and argue in favor of 2C. An appendix proposes a general formal template for propositional 2C semantics.

Functionalism in the philosophy of mind is the doctrine that what makes something a mental state of a particular type does not depend on its internal constitution, but rather on the way it functions, or the role it plays, in the system of which it is a part. This doctrine is rooted in Aristotle's conception of the soul, and has antecedents in Hobbes's conception of the mind as a “calculating machine”, but it has become fully articulated (and popularly endorsed) only (...) in the last third of the 20th century. Though the term ‘functionalism’ is used to designate a variety of positions in a variety of other disciplines, including psychology, sociology, economics, and architecture, this entry focuses exclusively on functionalism as a philosophical thesis about the nature of mental states. Defenders of pragmatic theories of knowledge (such as contextualism and sensitive invariantism) argue that these theories, unlike those that invoke a single standard for knowledge, comport with the intuitively compelling thesis that knowledge is the norm of assertion and practical reason. In this paper, I dispute this thesis, and argue that, therefore, the prospects for both “high standard” approach, and contend that if one abandons the thesis that knowledge is the norm of assertion and practical reason, the most serious arguments (...) against it lose force. We introduce a methodology whereby an arbitrary logic system L can be enriched with temporal features to create a new system T(L). The new system is constructed by combining L with a pure propositional temporal logic T (such as linear temporal logic with Since and Until) in a special way. We refer to this method as adding a temporal dimension to L or just temporalising L. We show that the logic system T(L) preserves several properties of the original temporal logic (...) like soundness, completeness, decidability, conservativeness and separation over linear flows of time. We then focus on the temporalisation of first-order logic, and a comparison is make with other first-order approaches to the handling of time. (shrink)

According to transhumanists who urge the radical enhancement of human beings, humanity’s top priority should be engineering “posthumans,” whose features would include agelessness. Increasingly, transhumanism is critiqued on foundational grounds rather than based largely on anticipated results of its implementation, such as rising social inequality. This expansion is crucial but insufficient because, despite its radical aim, transhumanism reflects beliefs and attitudes that are evident in the broader culture. With a focus on the yearning to eliminate aging, I consider four of (...) these: a disproportionate reliance on science and technology to address major human challenges; the conceptualization of human beings in terms of binaries like “young-old”; a repudiation of vulnerability; and intensifying perfectionism. Illuminating these interlocked commitments both deepens an existing critique of transhumanism and draws our attention to deleterious cultural views that must be vigorously contested if our commitment to human flourishing is to be deep and unwavering. Sentences $\varphi$ and $\psi$ are _cognitive synonyms_ for one when they play the same role in one’s cognitive life. The notion is pervasive (Sect. 1 ), but elusive: it is bound to be hyperintensional (Sect. 2 ), but excessive fine-graining would trivialize it and there are reasons for some coarse-graining (Sect. 2.1 ). Conceptual limitations stand in the way of a natural algebra (Sect. 2.2 ), and it should be sensitive to subject matters (Sect. 2.3 ). A cognitively adequate individuation (...) of content may be intransitive (Sect. 3 ) due to ‘dead parrot’ series: sequences of sentences $\varphi _1, \ldots, \varphi _n$ where adjacent $\varphi _i$ and $\varphi _{i+1}$ are cognitive synonyms while $\varphi _1$ and $\varphi _n$ are not (Sect. 3.1 ). Finding an intransitive account is hard: Fregean equipollence won’t do (Sect. 3.2 ) and a result by Leitgeb shows that it wouldn’t satisfy a minimal compositionality principle (Sect. 3.3 )._Sed contra_, there are reasons for transitivity, too (Sect. 3.4 ). Reliabilism holds that knowledge is true belief reliably caused. Reliabilists should say something about individuating processes; critics deny that the right degree of generality can be specified without arbitrariness. It is argued that this criticism applies as well to processes mentioned in scientific explanations. The gratuitous puzzles created thereby show that the “generality problem” is illusory.

We investigate synonymy in the strong sense of content identity. This notion is central in the philosophy of language and in applications of logic. We motivate, uniformly axiomatize, and characterize several “benchmark” notions of synonymy in the messy class of all possible notions of synonymy. This class is divided by two intuitive principles that are governed by a no-go result. We use the notion of a scenario to get a logic of synonymy which is the canonical representative of one division. (...) In the other division, the so-called conceptivist logics, we find, e.g., the well-known system of analytic containment. We axiomatize four logics of synonymy extending AC, relate them semantically and proof-theoretically to SF, and characterize them in terms of weak/strong subject matter preservation and weak/strong logical equivalence. This yields ways out of the no-go result and novel arguments—independent of a particular semantic framework—for each notion of synonymy discussed. This points to pluralism about meaning and a certain non-compositionality of truth in logic programs and neural networks. And it unveils an impossibility for synonymy: if it is to preserve subject matter, then either conjunction and disjunction lose an essential property or a very weak absorption law is violated. Fuzzy logics are many-valued logics that are well suited to reasoning in the context of vagueness. They provide the basis for the wider field of Fuzzy Logic, encompassing diverse areas such as fuzzy control, fuzzy databases, and fuzzy mathematics. This book provides an accessible and up-to-date introduction to this fast-growing and increasingly popular area. It focuses in particular on the development and applications of "proof-theoretic" presentations of fuzzy logics; the result of more than ten years of intensive work by researchers (...) in the area, including the authors. In addition to providing alternative elegant presentations of fuzzy logics, proof-theoretic methods are useful for addressing theoretical problems and developing efficient deduction and decision algorithms. Proof-theoretic presentations also place fuzzy logics in the broader landscape of non-classical logics, revealing deep relations with other logics studied in Computer Science, Mathematics, and Philosophy. The book builds methodically from the semantic origins of fuzzy logics to proof-theoretic presentations such as Hilbert and Gentzen systems, introducing both theoretical and practical applications of these presentations. In this paper I discuss the claim that the successful reduction of qualitative to physical states requires some sort of intelligible connection between our qualitative and physical concepts, which in turn requires a conceptual analysis of our qualitative concepts in causal-functional terms. While I defend this claim against some of its recent critics, I ultimately dispute it, and propose a different way to get the requisite intelligible connection between qualitative and physical concepts.

A growing body of literature has revealed ordinary causal judgement to be sensitive to normative factors, such that a norm-violating agent is regarded more causal than their non-norm-violating counterpart. In this paper, we explore two competing explanations for this phenomenon: the Responsibility View and the Bias View. The Bias View, but not the Responsibility View, predicts features peripheral to the agent’s responsibility to impact causal attributions. In a series of three preregistered experiments (N = 1162), we present new evidence that (...) the Norm Effect arises from such peripheral features, namely from nonpertinent or entirely silly norm violations. Furthermore, we show that this effect cannot be explained by recourse to the agent’s foreknowledge or desire of the outcome, nor by its foreseeability: the Norm Effect arises even when participants judge the norm-violating agent’s doing as equally foreseeable. This, we argue, provides evidence in favour of the Bias View. (shrink)

A common response to the paradoxes of vagueness and truth is to introduce the truth-values “neither true nor false” or “both true and false” (or both). However, this infamously runs into trouble with higher-order vagueness or the revenge paradox. This, and other considerations, suggest iterating “both” and “neither”: as in “neither true nor neither true nor false.” We present a novel explication of iterating “both” and “neither.” Unlike previous approaches, each iteration will change the logic, and the logic in the (...) limit of iteration is an extension of paraconsistent quantum logic. Surprisingly, we obtain the same limit logic if we use (a) both and neither, (b) only neither, or (c) only neither applied to comparable truth-values. These results promise new and fruitful replies to the paradoxes of vagueness and truth. With the escalation of terrorism worldwide in recent years, situations arise in which the perpetration of violence and the defense of human rights come into conflict, creating serious ethical problems. The Geneva Convention provides guidelines for the medical treatment of enemy wounded and sick, as well as prisoners of war. However, there are no comparable provisions for the treatment of terrorists, who can be termed unlawful combatants or unprivileged belligerents. Two cases of severely injured terrorists are presented here to illustrate (...) the dilemmas facing the medical staff that treated them. It is suggested that international legal and bioethical guidelines are required to define the role of the physician and auxiliary medical staff vis a vis injured terrorists. There are extreme situations where the perpetration of violence and the defense of human rights come into conflict, leading to serious ethical and psychological discord. Terrorists, using violence to create fear in order to further their political objectives, might require life-saving medical care if injured during the course of their terror activities. (shrink)
